Terms and Conditions of sale at niikura S.L.
The following terms and conditions apply to all transactions with Niikura S.L. on its Internet website. The use of this site indicates your acceptance of these terms and conditions, the placement of an order indicates your acceptance of these terms and conditions.
"We", "Us", "Our" and similar will always imply Niikura S.L.
Please read the terms and conditions carefully and print a copy for future reference.
Description of Goods.
All the products we sell are of a technical nature and it is not practical to publish full detailed specifications of all products. All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods.
Payment & Price.
The total price for the goods will be stipulated at the time of purchase, we are entitled to make adjustments to the price to take into account any increase in our suppliers prices or the imposition of any taxes or duties, or if due to any error or omission the price published for the goods is wrong. We will inform you of the correct price and give you the opportunity to cancel an order.
Typographical Errors.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any order listed at the incorrect price, whether or not the order has been confirmed. If your bank transfer has already been done we subsequently cancel your order, we will immediately issue a refund to your bank account for the full value of the incorrect price.
Payment Method.
Upon receipt of your order, you will receive a confirmation invoice. Please make the payment in accordance with the invoice.

Availability of Goods.
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods or services for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any losses you may incur if we do not supply the goods or services.
You are most welcome to contact us on sales@niikura.com and check the availability of any goods before making/placing an order.
Delivery.
All deliveries for total orders LESS than 50,- euro will be charged 6,- euro handlings and administration fee.
Delivery in Spain, Europe and the rest of the (world) countries will be charged as real delivery costs.
Deliveries can be done by registered mail, DHL or by customer preferred company.
Individual agreements made about, costs and delivery will be stated on personal pricelists.
Delivery Times.
Delivery of the products (stock items) in Spain will normally be made within 3 (three) working days, The rest of Europe may be up to 5 (five) working days from clearance of payment. We will endeavor to deliver goods within the timescale stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any timescale we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses or any other disbursement caused by any delay in the delivery of the goods.
If we are temporarily out of stock, we will notify you of this situation and you should allow up to 3 to 5 weeks for dispatch of goods.
For delays of 3 weeks or more you will have the right to cancel the order and we will refund any money paid by you for the goods.

Delivery address.
It is your responsibility to inform us a correct delivery address at the time of ordering. If you inform wrong information, we are not obliged to re-send the order to the correct address at our expense.
Change of delivery address is only possible as long as the order hasn't been dispatched, which means you must change it before you process the payment as we dispatch as soon as we receive your payment. You must notify the change of address by email to sales@niikura.com and we will send the confirmation of change of delivery address.
Risk.
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order unless special circumstances and by prior arrangement with permission allow us to alter this arrangement.
Goods will not be left without a signature.
From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note or other means at the time of delivery.
Time Limitation for Notification of Claims.
Damage in Transit - If goods arrive in a damaged condition, it will be your responsibility to inform us via email immediately (within 48 hours).
Shortages - In case of any shortages, it will be your responsibility to inform us via email immediately (within 48 hours).
Incorrect Goods - It is your responsibility to inform us via email immediately (within 48 hours) of any incorrect goods supplied.
Non Delivery - We will not accept liability for goods lost in transit unless we are notified within 5 days from the expected delivery date.
Please ensure the goods are in the original packaging and packed safely when returning. After inspection in our warehouse if goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration charge of 20% (twenty percent) of the price of the goods along with cost of re-delivery will be charged to your account.
This does not affect your statutory rights as a consumer.
Product Guarantees.
All products supplied are covered by the terms and conditions of the manufacturers guarantee for a period of 12 (twelve) months. This guarantee specifically EXCLUDES faults caused by accident, neglect and/or misuse, connecting to wrong Voltage and cosmetic damage is not covered.
Cancellation of Orders.
Before dispatch - the placement of an order confirms your acceptance that we have up to 3 weeks to dispatch your goods from cleared payment. For delays of more than 3 weeks you will have the right to cancel the order and we will refund any money paid by you for the goods.
If an order is cancelled simply because a customer changes their mind, we reserve the right to charge 10% (ten percent) of the gross price to compensate handling and administration.
Returned Goods and Refunds.
If you are not totally satisfied with your purchase, you can return it within 7 (seven) days from date of delivery for refund (excluding delivery charges) provided the goods are in pristine condition and in its unopened original packaging and packed safely when returning.
Returns for refund will not be accepted unless the company's previous consent has been obtained and either a claim under manufacturers warranty is involved, or Goods/parts proved incorrect and not to order, or the company expressly agrees to accept the returns for credit subject to a handling charge of 20% (ten percent) of the gross price.
Delivery charges
For all the products sold including the ones with "free delivery" offer, we will deduct de delivery charges incurred from the refund value.
You will be wholly responsible for the cost of delivery, insurance and safe return of the goods. Goods received back incomplete or in a damaged or used condition will be returned to you and the cost of delivery and administration where applicable charged to your account.
Goods returned incomplete and with accessories missing and if accepted by us will be charged and deducted from the refundable price due and less any delivery cost's)
Any 'FREE GIFTS' with the products must also be returned, and be in pristine condition.
Unsolicited Emails.
it is not our policy to annoy people with unsolicited emails but we do from time to time send our details of special offers or price reductions, if you wish to be removed from our mailing list then simply contact us either by telephone, facsimile or email and we will gladly remove your details, this will usually be done within 5 (five) working days. You can also specify that you wish not to be added to our list when first contacting us by email.

Complaints Handling.
Complaints can be made via email (see below).
All complaints are acknowledged within 5 (five) working days and generally resolved within 10 (ten) working days. We take all complaints very seriously and all complaints are dealt with fairly and confidentially. Proprietors and senior managers review ALL complaints regularly.
